SC To Pronounce Final Verdict On Constitutional Validity Of Article 370 Today

The Supreme Court is expected to pronounce its final verdict on constitutional validity of abrogation of Article 370 of the Constitution that granted special status to Jammu and Kashmir and bifurcated the state into two Union Territories.

This comes after a batch of petitions challenging the abrogation filed in the apex court.

The verdict will be delivered today by a five-judge Constitution bench headed by Chief Justice of India DY Chandrachud.

The petitioners in their petitions have claimed that the Centre cannot unilaterally scrap Article 370 as the Constituent Assembly vested powered in the Jammu and Kashmir legislature after it was dissolved in 1957.

As per the rules the Constituent Assembly is required to give nod to abrogate Article 370, which the Constitution held temporary. The top court questioned how the Article became permanent when the Constituent Assembly was dissolved.

Meanwhile, the Centre in its argument has said that the decisions were taken within the legal framework only. It even claimed that the mainstreaming of J&K has reduced terror and provided a level playing field.

The Centre has even argued that in last four years, the state has fast-tracked itself on developmental path.

The fundamental rights as part of Constitution could not apply to residents of Jammu and Kashmir before the abrogation of Article 370 which apply automatically to every India citizen, the government said.
