SC To Hear Petition Challenging Deportation Of Rohingya Refugees

The Supreme Court is set to hear a petition seeking release and protection of over 150 Rohingya refugees in Jammu and Kashmir. The administration will work on the deportation of those refugees to Myanmar, said the administration of the Union Territory.

A bench headed by the Chief Justice SA Bobde will hear the petition. A week ago, the bench had also asked the solicitor general Tushar Mehta to come with a response to the petition.

A Rohingya refugee, Mohammad Salimullah had filed an intervention application with advocate advocate Prashant Bhushan. It additionally looks for heading to Ministry of Home Affairs to speedily provide refugee identifaction cards through the Foreigners Regional Registration Office (FRRO) to the Rohingyas in the casual camps.

The petition was filed to safeguard the rights ensured under Article 14 and Article 21, read with Article 51(c) of the Constitution, against the deportation of Rohingya refugees who have taken asylum in India in the wake of getting away from boundless brutality and oppression against their community in their own nation Myanmar.

It has also sought an order to the Union government for not implementing the deportation of Rohingya refugees, who are under detention in the Union Territory. “There is a military government in Myanmar now. Their life is under threat,” referring to latest coup in Myanmar Bhushan demanded an urgent hearing over the petition.

According to the data registered in the official documents in the Deputy Commissioner office of Jammu, currently there are about 6,523 refugees in Jammu, said the petitioner.

The Jammu & Kashmir administration began the process of identifying undocumented immigrants on March 6. Over 150 of them were sent to a holding centre under the Foreigners Act. Officials insisted due process of law was followed and added the immigrants sent to the centre did not carry any valid travel documents.

On March 6 the administration of the Union Territory started finding the unregistered immigrants. After which total 150 of them were sent to the detention centres. Officials were asked to follow the due process of law and to make sure that the detained immigrants do not carry any travelling outpass.

Last year on January 10, the Supreme Court had said that it will hear a bunch of pleas pertaining to the illegal deportation of the Rohingya refugees to Myanmar.
