Allahabad HC Orders Private Schools To Return 15% Of Fee Collected During Covid Lockdowns

Parents can now breathe a sigh of relief as the Allahabad High Court ordered private schools to forgive 15% of the fees they collected for the Covid-19 term. The choice is final for the academic year 2020–2021 at all Uttar Pradesh schools.

The next academic session shall compute and modify 15% of the fees in accordance with the court directives. The Court mandated that the amount be computed and repaid to students who had left school or dropped out. Within two months, you must finish this task.

In light of the Covid-19 pandemic scenario, parent organisations have been requesting relief from the Allahabad High Court in the form of a reduction in school tuition. On January 6, 2022, the High Court heard all of the petitions. This decision was made on Monday by a bench consisting of Chief Justice Rajesh Bindal and Justice JJ Munir. After taking into account that there was a lockdown throughout the 2020–21 school year but that the schools were still demanding full tuition from the parents despite the fact that classes were only being held online, the decision was made.

Petitioners argued in their appeal that during that session, private schools did not offer any services beyond tuition. Additionally, the petitioners cited the Supreme Court’s most recent ruling in the matter of Indian School, Jodhpur v. State of Rajasthan. In its ruling, the Supreme Court stated that charging tuition without also providing facilities amounted to the commercialization and profiteering of education.

In accordance with the court rulings, the institution will waive 15% of all fees for the 2020–21 academic year. In case the student drops out, the extra money should be used to the following academic year or reimbursed to them.
